Health minister tables mental health bill

The Minister of Health and Social Services Dr. Esperance Luvindao on Tuesday tabled the Mental Health Bill of 2025 which will replace the current Mental Health Act (Act No.18 of 1973).

While motivating the proposed amendments in Parliament, Luvindao said the bill, will criminalise abuse, neglect, exploitation, and ill-treatment of patients, amongst others.

The bill also sets out penalties for misconduct by health care staff, including acts of cruelty, sexual abuse, or unlawful disclosure of information.

It also places a duty on the State to implement policies, designate facilities, and provide comprehensive primary, secondary, tertiary, and community-based care.

The new legislation is aligned with article 8 of the constitution which deals with dignity and Article 10 on equality, and it gives effect to Namibia’s commitment on inclusive development, as enshrined in Vision 2030, Universal Health Coverage and the Sustainable Development Goals.

The bill further protects personal integrity, dignity, forced sterilisation, and restricts the use of seclusion and restraint to the strictest conditions.
